On February 17, the Court of Appeals of Santiago rejected the appeal for protection filed against the Executive Director of the Environmental Evaluation Service for not suspending the effects of the environmental qualification resolution approving the “Saneamiento del Terreno Las Salinas” project. This reaffirms that the entire evaluation process was carried out in accordance with current legal regulations, which concluded with the approval of the Environmental Qualification Resolution (RCA) unanimously in 2020, by 21 services and technical agencies. The rejected appeal for protection had been filed by the Corporación Pro-Defensa del Patrimonio Histórico y Cultural de Viña del Mar (Corporation for the Defense of the Historical and Cultural Heritage of Viña del Mar) and other appellants. Among the grounds established in the Court’s decision, the following points stand out: it emphasized that the decision recognized the legality of the actions of the Environmental Evaluation Service and the respect for the constitutional guarantees of the appellants. The environmental remediation project to clean up the remaining contamination on the site was prepared by a Scientific Committee made up of academics and researchers from leading universities in the Valparaíso Region and recognized by the scientific community, and the international consulting firm Golder, which established that the most effective and safe alternative to address the final stage of remediation is bioremediation, a technique that uses the microorganisms naturally present on the site as hydrocarbon degraders and that does not impact people and is not invasive to the environment. stressed the importance of the resolution which confirms the continued adherence to the law of the environmental evaluation process of the remediation project and the autonomy of the competent environmental evaluation authorities, which allows further progress in fulfilling the company’s commitment to the city, to integrate this land into the urban development of Viña del Mar as a land free of risk to people and available for the harmonious development of the city,” said Undurraga.
